Terms & Conditions

Agreement between Split Academy and Member

Split Academy maintains the splitacademy.com Website ("Site"). The following are the terms of use that govern our Services ("Terms & Conditions"). By using the Site you expressly agree to be bound by these Terms and the splitacademy.com Privacy Policy and to follow these Terms and all applicable laws and regulations governing use of the Site. Split Academy reserves the right to change these Terms & Conditions at any time.

1. Definitions

1.1 Terms - refers to our Terms & Conditions available on our website.

1.2 Parent or Legal Guardian - this refers to one of the parents responsible for a child bellow the age of 18 years.

1.3 Coach - means the coaches, trainers or teachers engaged by Split Academy to provide services to a Member.

1.4 Member - refers to the individual registered through Split Academy’s channel pursuant to the payment of a Membership Fee attending classes.

1.5 Staff Members - means our employees, coaches and freelancers in Split Academy.

1.6 Student - means junior Member attending to our classes or free trials.

1.7 Membership Fee - means the fee payable by Member to Split Academy as stated in the Terms which may be in place time to time.

1.8 Management - member of staff in charge for Split Academy.

1.9 Make up - means additional session offered to the Member.

2.0 Free Assessment - means a free trail class for a period of 10-15 minutes.

2. Participation

In the case of participation of underaged the Parent or Legal Guardian of a child referred as Member; or Member as responsible adult release Split Academy from any responsibility and acknowledges the following:

2.1 A healthy physical constitution of the Student / Member attending classes in Split Academy;

2.2 To have informed the Coach for any medical condition that might prevent sporting exercise, or a doctor contraindication to execute physical activity in general;

2.3 To be aware and understood the risks that might arise during hazardous sporting activities.

2.4 To want to release and exempt Management and Staff Members from any judicial or arbitral proceedings including but not limited to those relating to the risk of injury during the participation in classes and trials; loss of belongings, damages or other reason.

2.5 To be informed on the rules of participation in activities and accept the measures adopted by Split Academy as suitable to avoid accidents or injuries.

2.6 Due to the technical skills of our activities, from time to time it is necessary for our coaches to use some level of physical contact to support an individual when learning how to perform a technique or skill accurately, assist the student in posture and alignment correction or in repositioning the body to ensure that the movement is completed safely.

2.7 Parent and Student need to be reassured that this is always done with sensitivity and in a totally non threatening manner and is purely to benefit the individual’s performance levels and skill set. Should a student feel uncomfortable in any way, the teacher will no doubt recognize this and either step away, discuss the matter further or adapt the technique without contact as far as possible.

2.8 Students are expected to arrive on time, suitably dressed for their activity and prepared to work hard.

3. Personal Data

3.1 As Member you ensure under your responsibility that all your personal details are up to date with Split Academy’s database by filling our registration form; and you might inform Split Academy’s Staff Members during school term for such update.

3.2 It is essential for the Member to provide a correct emergency contact details, requested by Split Academy. All details are held by us in strict confidence and we will never share your data to third parties.

4. Use of Image

We offer trial classes for prospective Members which acknowledge our Terms.

4.1 As a Member I accept to give consent to Split Academy to use my personal data, image may be embodied in pictures, photographs, video recordings, audiotapes, digital images or any other materials taken or made on behalf of Split Academy likeness of the company’s interests, its Staff Members and their activities. This use might include social networks, advertising, illustrations, exhibitions, reprints, reproductions, publications, brochures, promotional or educational material not yet known or later developed, including our website and the internet.

4.2 Member will not claim any compensation for the use of media contents and; hereby release Split Academy from any claims which are in a way connected with such a use.

5. Membership Fess

5.1 Membership Fees are payable termly in advance prior to class attendance in reference to the school calendar and school term.

5.2 The Members ensures to pay the correct amount by outlined due date.

5.3 If the student is commencing mid-term, by the start of the second class undertaken. Unless prior written agreement with Management is obtained, students whose fees have not been paid will not be able to commence lessons.

5.4 Make-up sessions will be offered where due to unforeseen circumstances, the Coach has had to cancel the class. Parents will be informed as soon as possible if this occurs.

5.5 Payments may be made by cash, cheque or by Bank Transfer: If you pay by Bank Transfer, please remember to add your child’s name to help Split Academy operation effectively.

6. Cancellation Policy

6.1 As we automatically “roll over” attendance to class registers at the end of each term to ensure student places are retained for existing students, parents are responsible for informing Management should they not wish to continue with their participation.

6.2 This cancellation must be completed prior to the start of term to avoid any unnecessary confusion with the allocation and payment of class fees. Cancellations must be in writing to avoid any liability for the payment of that term’s fees. If you wish your child to discontinue any class or leave mid-term, please be mindful that we operate a strict no refund policy in these situations.

6.3 In the event that due to Health or Safety reasons relating to Covid-19 classes are unable to continue on site refunds will not be issued. Online classes will be offered if appropriate for the age and style of class. Should an online class not be offered or you wish for your child to opt out of online learning, class fees will be held as credit until we return to being back on site.

6.4 We require written approval for the cancellation of imagery of our students. Member agrees to give Split Academy the right to take videos and photographs for advertising / promotional purposes during class activities. Hesitant Member shall inform Management in writing for the case of videos and photographs not to be taken or deleted.

7. Communication

7.1 At the time of registration the Member email address will be automatically added to our service mailing list. Only service announcement and updates information will be sent.

7.2 Member is responsible to check the email address provided during sign up for our service emails, invoices, and communications. We are not responsible for undelivered emails or emails trapped in spam boxes.

8. Changes to the Terms

8.1 We reserve the right to revise these policies at any time without notice. Last update of these Terms: 18/05/2022. These Terms are governed by the laws of the United Arab Emirates. Split Academy is registered and approved by the competent authorities in the United Arab Emirates.

9. Disclaimer

9.1 We will not be responsible for any damages and the Member acknowledges that there are specific risks of physical injury or property damage and losses that may result from your child’s participation with Split Academy and you voluntarily assume that the risks are acceptable and associated with such activities. We make no warranties of any kind, expressed or implied for services we provide.
